AB 1086 (Daly) Housing: regional housing needs.


(1)  Limits the extent to which the forecast made by the Council of Governments (COGs) may be used in lieu of the state forecast.  Current law provides that the COG number may be used if its within 3% of the regional population forecast proposed by the Department of Finance.  The new range would be cut in half to within 1.5%. (2) Requires COGs to use the definition of "overcrowding" for sale and rental housing (e.g., more than one person per room) used in HCDs 2017 report  “California’s Housing Future: Challenges and Opportunities."

  • HCD Report.  Read the HCD Report: California’s Housing Future: Challenges and Opportunities, see page 16 for the discussion of overcrowding.  

  • Mandate Exemption Incorrect.   Incorrectly assumes that COGs have the power to levy service fees to determine that no reimbursement is required under Section 6 of Article XIII B of the California Constitution (which states that reimbursement is not required when the agency has the authority to levy service charges, fees, or assessments sufficient to pay for the program or level of service mandated by this act, within the meaning of Section 17556 of the Government Code).  Councils of Governments have no authority to levy such a fee.
